Obrafour Sues Drake $10 Million Over Alleged Copyright Infringement

Canadian rapper Drake is facing legal action from Ghanaian hip-life artist Obrafour for alleged copyright infringement.

Obrafour is seeking $10 million in damages as compensation for Drake sampling his 2003 released remix of ‘Oye Ohene’ on the song ‘Calling My Name’ off Drake’s Honestly Nevermind album.

Court documents shared on social media by Robert Freund, a lawyer for brands, agencies, and creators, indicate that Obrafour claimed Drake violated his copyright by using a portion of his song without his permission, and that parties involved in the making of ‘Calling My Name’ have financially benefited from his work.

In court documents filed in New York, Obrafour stated that Drake and his team had previously approached him seeking permission to use the sample in the song, but were denied.

Despite the refusal, Drake released the track, causing damage to Obrafours reputation and financial loss due to potential royalties.

According to Obrafour, the respondents in the case have benefited greatly, including producing enormous sums of global streams and sales across a variety of platforms, while also taking advantage of him through other methods, such as live performance.

The Infringing Work has been streamed over 4.1 million times on YouTube, over 47,442,160 times on Spotify, and tens of millions of times on Apple Music in just 304 days since its release.

Obrafour is also seeking a dictum requiring the defendants and their agents, employees, officers, attorneys, successors, licensees, partners, and assigns, and all persons acting in concert or participation with each or any one of them, to cease directly and indirectly infringing, and causing, enabling, facilitating, encouraging, promoting, inducing, and/or participating in the infringement of any of Obrafours rights protected by the Copyright Act.
